Special Education Welcome
Special Education Report 2018-2021
Understanding Special Education Rights
On June 30, 2021, Governor Tom Wolf signed Act 66 of 2021 into law. This legislation allows parents and guardians to elect to retain their child for the 2021-2022 school year at the same grade level their child was in during the 2020-2021 school year, regardless of whether the student earned enough credits to be promoted. On July 6, 2021, PDE released the Act 66 Request Form for parents to submit their request if they choose to do so. The legislation requires that Act 66 Request Forms are submitted to the student’s school district on or before July 15, 2021. You may access a copy of the form at the Act 66 Form link or contact the Midland Borough School District at 724-643-8650 to receive a copy. Act 66 Form
ACT 66 permits the following for the 2021-22 school year:
- A student who was enrolled during the 2020-21 school year may repeat their 2020-21 school year grade level in an effort to make up for any lost educational opportunities due to the COVID-19 pandemic, even if the student met the requirements to be promoted to the next grade level; and
- A student with a disability who was enrolled during the 2020-21 school year and turned 21 (either during the 2020-21 school year or during the summer of 2021) may attend a school entity during the 2021-22 school year and receive services as outlined in their most recent Individualized Education Program (IEP) with all protections under the Individuals with Disabilities Education Act (IDEA)
